Terms and Conditions for Rental of a Gooseberry Yurt
By entering into a contract to rent from us, you agree that you have read and understand these terms and conditions and agree to abide by them. You concur that, for reasons of expedience and for your convenience, we do not require mailing or faxing a formally signed Rental Contract but that, instead, this document, together with the personal data submitted with the e-mail into which it is incorporated, serves as a binding Rental Contract. Specifically, you agree to unconditionally pay such charges as may be presented to you in writing and may result from careless treatment of the premises and/or not following these terms and conditions.

Occupancy Restrictions: No more than 7 persons in the yurt, unless special written permission is obtained from manager.
Pets and Smoking: No pets are allowed in units unless special permission is obtained from the manager ; smoking not permitted anywhere or within 20 feet of the yurt. Violation will result in loss of entire deposit and/or additional charges.
Guns Absolutely no discharging of firearms on the yurt property.
Yurt Inspection: Manager inspects units immediately before and after each rental. Upon arrival at the yurt, it is your responsibility to report damages to the Manager. Unless a report is made at the start of the rental period, it is assumed the unit condition is as per the manager’s inspection.
Pricing and Availability: Current rental charges are $175 + taxes per night on Sunday through Thursday. On Holidays, Fridays and Saturdays, the price is $225 + taxes per night. The Yurt is subject to price and availability changes without notice, until the Rental Agreement is accepted by payment of the Security Deposit. All reservations are final. Time is essential.
Two payments are required:
Security Deposit: Payment of the $100 refundable security deposit is required to reserve the requested dates.
Yurt Rental Fee: Payment for the yurt rental and taxes are due as specified on the invoice. This is usually 1 week prior to the date of the rental. At this point, instruction on picking up a key and arriving at the yurts will be emailed.
Acceptable Payment Options: Payment via PayPal (no fee applies to this payment) is the preferred method. No PayPal account necessary.
Cancellation Policy: The time factor is critical in vacation rentals, and your reservation will hold this rental off the market for a period of time. For cancellations made more than 30 days prior to your arrival date, we will refund all rents paid minus a $25 fee. For cancellations within 30 days and before 7 days of the arrival date, no refunds will be made, but all funds can be applied to future reservations at Gooseberry Yurts. THERE ARE NO REFUNDS OF RENT FOR CANCELLATIONS MADE LESS THAN 7 DAYS PRIOR TO ARRIVAL (you forfeit your entire rent, but we will refund your deposit).
As a courtesy to our customers, in the event of a cancellation, we will work to find a tenant to occupy the vacated time reserved under this contract. If we are able to find a suitable tenant, we will refund the rental fee, less a $50 service fee. The earlier you warn us that you may need to cancel, the better the chance of re-renting.
Inability to Access the Yurt due to Inclement Weather: You agree to assume responsibility for transportation to the property. The road to Gooseberry Mesa is dirt and gravel, and in good weather conditions, is accessible from the south end of Smithsonian Butte Road with most two-wheel drive cars with normal clearance. However, in wet and rainy conditions, the road quickly becomes impassable.
In such cases, we will work with you to reschedule the Yurt rental. If rescheduling is not possible, we will fully refund all security deposits and rental fees. The renter agrees to release, indemnify, and hold harmless the Gooseberry Mesa LLC for any cost or inconvenience incurred in the event of being unable to access Gooseberry Mesa.
Security Deposit: A security deposit (“Deposit”) is required for all rentals and will be fully returned subject to, but not limited by the following: a) there is no damage to the premises beyond normal wear and tear; b) there are no items missing from the premises on the day of departure; c) all debris and garbage have been removed; and d) there are no unpaid, late or outstanding rent or other charges owing. Any material breach of the lease agreement or the general or specific home rules during tenancy may be, in the sole judgment of the owner, cause for forfeiture of the entire deposit. Deposit refunds are mailed within 21 days of departure. However, there are times that a certain amount will be withheld even longer to await any and all necessary future charges (eg, in the event of damages/repairs). Guests will be notified of any Excess Damage Costs in writing.
Damages are not limited to security deposit. In the event damages are greater than the security deposit, we reserve the right to charge for full damages to your credit card and/or seek full compensation.
Attorney’s Fees and Costs: If the owner employs the services of an attorney to enforce any conditions of this Agreement, to collect any amounts due, the eviction of the Guest, or because the Guest takes any action to recover deposits not due, then the Guest shall be liable to Owner for all attorney’s fees and costs incurred by Manager.
Check-In and Check-Out Key: Check in / Check out time is noon. Upon payment of all rental charges, you will receive the information to obtain entry to the premises. Late check out, unless pre-arranged with owner, is grounds for security deposit claims.
Use at Your Own Risk: You agree to notify us immediately if a maintenance problem develops at the yurt so we can have it remedied as quickly as possible. Owners and Managers reserve the right to make repairs as necessary, and to enter the yurt with reasonable notice, or without notice if you cannot be reached.
Indemnification and Insurance: The Guest agrees to indemnify and hold harmless Manager and owners of the property against all loss, damage, expense, and penalty arising from any injury, death or damage to property that occurs during time spent at the yurt and the surrounding area. Guest is encouraged to secure the appropriate traveler’s or vacation insurance and/or renter’s insurance.
Falsified Reservations: Any reservation obtained under false pretense will be subject to forfeiture of Reservation Deposit and Final Balance, if paid, and such party will not be permitted to check-in and/or will be subject to immediate eviction with the forfeiture of all amounts paid.
The guests shall supply:
All necessary water for drinking, bathing and cleaning.
Wood for heat and fire. NO WOOD GATHERING allowed on the property. ROCK GATHERING (including petrified wood) is also NOT ALLOWED on the property.
Coleman type gas canisters for the cook stove and lantern.
Sleeping bag, pillows and bedding supplies.
Food, drink, cooler and ice.
Garbage bags and toilet paper
The owners shall supply:
Camp stove and Lantern
Cups and plates, pots and pans
Outhouse – Pit Toilet. NO OPEN DEFECATION or defecation holes are allowed on the property. Outhouse Pit Toilets also available at various trail heads on the Mesa.
General Terms: This Agreement is made in, and shall be governed solely by the laws of, the State of Utah and Utah Statutes. If any section, clause, paragraph or terms of this Agreement is held or determined to be void, invalid or unenforceable, for any reason, all other terms, clauses or paragraphs herein shall be severed and remain in force and effect. This Agreement is taken in full compliance with federal, state and local Fair Housing Laws, without regard to race, color, religion, sex, country of origin, handicap or familial status.
Arrival: Instructions for obtaining the key will be provided to you once the final payment has been made.
Departure: Close up all windows and lock the door. Follow the check-out list posted in the Yurt.
